AD ASKS ELECTORAL COMMISSION TO REINSTATE NEARLY 1,000 EU CITIZENS CANCELLED FROM EUROPEAN ELECTORAL REGISTER
Alternattiva Demokratika – The Green Party is asking the Electoral Commission to reinstate nearly 1,000 EU citizens who were on the European electoral register from April 2004 -€ ¢ till October 2008 and then unexplainably struck off the last electoral register published this April 2009.
Stephen Cachia, Alternattiva Demokratika Spokesperson on Democracy, stated: “The General Elections Act, which is also valid for the European elections unless otherwise stated, states at Chapter 354, Article 26 (1) that before the Electoral Commission deletes the registration of electors from the Electoral register, it has to send written notice to the individual concerned for him/her to give the necessary information or proof that she/he has a right to vote”.
Victor Galea, AD Secretary General, added: “The Act on European Parliament elections, at Chapter 467, 13 (2) states that the dispositions of the General Elections Act concerning the deletion of voters from the register apply also to the Act on European elections, unless otherwise provided. The Article 14.1 also states that “The Electoral Commission has the right, whenever it deems opportune, to ask a person whose name has appeared on the Electoral Register of the European Union to make a new declaration regarding its particulars and residence status”.
Arnold Cassola, Alternattiva Demokratika Chairperson, concluded: “The Electoral Commission, probably unintentionally, has not observed the law. € ¢ It has neither sent written notice to the individuals concerned as per Chapter 354, Article 26 (1) of the Act on General Elections before deleting them from the Electoral Register nor has it asked these persons whose name already appeared on the Electoral Register of the European Union to make a new declaration regarding their particulars and residence status before deleting them”.
“In view of this presumably unintentional oversight regarding the rights of voters, Alternattiva Demokratika is asking the Electoral Commission to reinsert these nearly 1,000 non Maltese EU voters in the electoral register. We ask the Prime Minister and the Leader of Opposition to appeal to the Electoral Commission, which is made up of persons nominated by PL and PN, reinstate these persons in the electoral register and avoid the injustice they will otherwise suffer”.
AD is informing the EU Commission and EU Parliament of its request for reinstatement of all struck off voters.
